Earthshot Prize: 2022 Finalists Announced

Following a successful first year, the cohort of finalists for Year 2 of the Earthshot Prize have now been announced. Over 1000 nominations from 100 countries have been narrowed down to fifteen finalists, three in each of the five categories – the “Earthshots” – Protect and Restore Nature, Clean Our Air, Revive Our Oceans, Build A Waste Free World and Fix Our Climate.

Intervening in EPO opposition proceedings

The deadline of 9-months from grant for opposing a European patent is one of the few absolute deadlines set by the European Patent Office but it does not represent the last chance to get involved in EP opposition proceedings.  Even if you have missed this 9-month term there is still, under very specific circumstances, the opportunity to “intervene” in pending opposition (or opposition-appeal) proceedings.

Louis Vuitton loses acquired distinctiveness battle

In a recent decision, the European Union’s General Court (GC) held that the EUIPO’s Board of Appeal (BoA) was correct to find that Louis Vuitton (LV) failed to demonstrate that its Damier Azur pattern had acquired distinctiveness through use in the European Union in relation to a variety of goods in class 18 (handbags, purses, wallets, luggage etc.).
