A new joint study by the European Patent Office (EPO) and European Union Intellectual Property Office (EUIPO) shows that start-ups which file applications for registered Intellectual Property Rights (IPR) – including patents, trademarks, and designs – demonstrate a higher likelihood of securing funding from Venture Capital firms (VCs) and achieving favourable exit outcomes for their investors.

As of 1 June 2023, the Unitary Patent and the Unified Patent Court (UPC) have been in effect. During the 3 month sunrise period (covering the period 1 March to 31 May 2023) and subsequently, proprietors of European patents and applicants of pending European patent applications have been able to file opt-out requests to avoid those European rights (if and when granted) falling under the jurisdiction of the UPC.

At Oral Proceedings we were involved with earlier this week, the Board of Appeal decided to refer questions to the Enlarged Board of Appeal relating to the legality of holding Oral Proceedings before the Board of Appeal by video conference without consent of all parties. This referral may therefore put on hold Appeal hearings at the EPO whilst it remains difficult for parties to travel to Haar to attend Oral Proceedings in person.

In a report of 12 March 2020 titled Digital technologies take top spot in European patent applications, the European Patent Office reports overall European patent applications were up by 4% in 2019 compared to 2018. Best performer in 2019 was digital communications with an almost 20% rise pushing medical technologies off the top filing technology spot for the first time since 2006.
