Two of the most popular topics at present are artificial intelligence (AI) and climate change. In this insight we explore the overlap between the two, particularly how AI can be applied to improve climate change combatting technologies, as well as reviewing aspects of several patent applications to highlight important considerations when seeking patent protection for such AI related inventions.

There are various stages that a patent application goes through before it can be granted. These stages include search, publication and examination. In general, a UK patent application takes around two to four years from filing to go through these stages and reach grant. However, some applicants wish to obtain a granted patent more quickly. The UK Intellectual Property Office (UKIPO) will accelerate processing of a patent application if an applicant can demonstrate why acceleration is important. For example, if infringement by a third party can be demonstrated. Another option for accelerated processing is the UKIPO Green Channel, which is available if the patent application relates to an invention that has an environmental benefit. There is no official fee for using the Green Channel.

As the UK hosts the COP26 climate summit in Glasgow, the world is watching to see if global leaders can come to an agreement on how to tackle the issue of climate change. In November 2020 the UK Government published their Ten Point Plan for a Green Industrial Revolution. Point 8 of the plan focuses on investing in carbon capture, usage and storage (CCUS).

As the global energy sector moves to renewable energy sources, many of the technologies needed to replace fossil fuels and cut greenhouse gas emissions are not yet fully mature. A recent report from the EPO outlines why the net-zero goal cannot be achieved without further efforts in clean energy innovation.
