Optis And Unwired Planet v Apple [2021] EWHC 2564 (Pat) – in FRAND disputes what is a willing licensee? And does Apple’s desire to “pick and choose” make them an unwilling licensee?

The expected standard of behaviour of a Standard Essential Patent (SEP) holder and a potential licensee involved in a patent dispute, and considers the opposing arguments put forward by Optis and Unwired Planet (as patentee) and Apple (as defendant) seeking to determine the correct approach to negotiating a licence on Fair Reasonable and Non-Discriminatory (FRAND) terms.

Manchester United sues the producers of Football Manager® for trade mark infringement

Manchester United FC has initiated trade mark infringement proceedings in the High Court against SEGA Publishing Europe Limited, the European arm of the Japanese video-game brand, and Sports Interactive Limited, producers of the video game Football Manager®. The game Football Manager® has been around since 1992 and is a hugely successful football management simulation video game.  Players can manage their own virtual equivalents of real life clubs, controlling everything from pre-season transfers to the tactics on the pitch.

CJEU answers UK reference arising from the UK High Court litigation between Sky and SkyKick on issues relating to bad faith and validity

In February 2018 we reported on the decision of Mr Justice Arnold in the UK High Court trade mark litigation involving various Sky companies (Sky plc, Sky International AG and Sky UK Limited – ‘Sky’) and SkyKick (SkyKick UK Limited and SkyKick Inc). On 29 January 2020 the Court of Justice of the EU (CJEU) delivered its judgement on the questions referred by the UK court. Details of the CJEU’s judgement and what it means in practice are set out below.
