It has been five months since the Unified Patent Court opened its doors. Although the number of substantive actions filed at the new court is not quite what some commentators initially expected, there have been a steady number of actions filed by parties from all over the world across a wide range of technologies.

The start of the Unified Patent Court shows that, as expected, Munich is the venue of choice for UPC patent litigation and in particular patent owner plaintiffs. Following the transfer of two revocation actions from Paris, there are now nine UPC cases pending before the two UPC divisions in Munich, fifteen before the UPC divisions in Germany, two before the Nordic-Baltic regional division and one in Milan. Thus, case filings heavily concentrate on Munich, with the remainder scattered across Europe or the remaining German local divisions Hamburg and Düsseldorf.

The amount of data generated in life sciences is increasing exponentially. This has largely been precipitated by the advent of “-omics” technologies which facilitate high-throughput measurement of all molecules of a certain type from a biological sample. Whereas once a PhD project may have been concerned with analysing the expression of a single gene, nowadays a PhD project more likely involves collecting information about the expression of all genes in multiple cell types and conditions. This has left researchers data-rich, but not necessarily information-rich. However, machine learning approaches can be used to interrogate these large datasets for trends or patterns to provide information.

The World Intellectual Property Organization (WIPO) reported that the number of Patent Cooperation Treaty (PCT) international applications with at least one female inventor was 33.3% in 2021, although only 16.5% of all inventors were women.

Following on from my recent Blog of 7th May [insert link please], we are beginning to get preliminary reports of the Supreme Court’s Decision of 12th May 2021, concerning already-granted patents with a term of ten years from grant; in particular, whether these patents will retain this term.
